Action in the Hennepin County District Court for personal injuries allegedly sustained by plaintiff as the result of an assault by defendant. Defendant filed a third-party complaint against his insurer, Indiana Lumbermens Mutual Insurance Company of Indianapolis, Indiana. The case was tried before Thomas Tallakson, retired judge, and a jury. On the basis of answers to special interrogatories the court found plaintiff entitled to recover $29,510 compensatory damages and $4,000 punitive damages and dismissed the third-party action against the insurance company. Thereafter, the court denied plaintiff's motion for amended findings and granted defendant a new trial unless plaintiff consented to a reduction of damages to $15,000 compensatory damages and $2,000 punitive damages. This court granted plaintiff discretionary review of said order and defendant filed a notice of review as to it. Defendant also appealed from the judgment entered dismissing the third-party action.
