This is a quiet title action between adjoining landowners to resolve a boundary dispute. Plaintiff respondent (Wells) claimed title to a certain disputed parcel of land under theories of written agreement, boundary by acquiescence and adverse possession. At the district court level both parties moved for summary judgment, and the district court denied appellants motion and granted respondents motion on the grounds of boundary by written agreement, boundary by acquiescence and adverse possession. The Court of Appeals in turn affirmed the district courts decision on the theory of boundary by agreement. Appellant petitioned the Supreme Court for review; we accepted and affirm the decision of the district court.
